Site Musings: How this site is organized

The official site at the Administrative Office of the Courts contains the following information and pages that we monitor and then post as appropriate:

  • Press releases or official news dispatches
  • Minutes from rendition days, or the day the court announces the orders and decisions - published not to be published).  SCOKY issues minutes ONCE a month (3rd Thursday each month except for vacation in July).  COAKY issues minutes each Friday of the month.
  • Argument calendars. Posted a few months in advance.
  • Decisions.  Published and not for publication decisions are posted in complete text which is searchable when the minutes are announced.  SCOKY decisions go back to 1999 and COAKY back to 1996.
  • Orders (whenever found since no press release accompanies these).
  • Announcements or news when noted on the site or right side of their main page.

How, when and what we post:

  • The minutes are posted within days of their rendition.  We link to the minutes index at the site, and our own index copy which highlights the published decisions.  This announcementn of the minutes identies the date of the decisions, the numbers of those published, and for a while we are keeping a running tab of the senior status judges roles in those published decisions.
  • The arguments are posted at the beginning of the month with a link to the actual argument page from the AOC.
  • We are trying to post more detailed information on each argument the week before, to include dates and times, locations, case and issues.
  • Each PUBLISHED decision is posted as a separate blog entry after it has been digested by one of the editors.  The decision name, link to full text, action, presiding judge, date, key word description, and summary of the decision.  The editor digesting this decision is also noted.
  • The Louisville LawWire is a compilation of the decisions.  It is published separately and contains a link to the minutes for that week, the published decisions (with the same information from the digested post), and the "Not to be Published" decisions with a short key word desctiption and link to the decision.   The value of this is that you have a quick run-down on the decisions rendered in one post.  The Lawwire is stored at a separate site with a link from the site.  The Lawwire is published in "html" and "pdf" format.  The latter for those who wish to print it and read it at their leisure or post in a binder.

Each page is organized with:

  • Listing of the categories upon which we organize the posts (the decisions are posted by court (SCOKY and COAKY) and subject matter (Criminal); the minutes are listed in a separate category, as well as Lawwire and arguments).  By clicking on category you can filter out just those cases and posts under that subject category.
  • Listing of the most recent posts.
  • LIsting of the most recent comments.
  • Listing of the editors who volunteer their time and effort in providing this service.

The Kentucky Law Review (at www.KentuckyLawBlog.com) is more of a running commentary and posting on news, cases, and other items of import in Kentucky with links announcing the posting of the minutes and LawWire.

The Kentucky Cases at www.KyCAses.com (to be renamed shortly to the Kentucky Court Report) is akin to nearly official site of information with minimal or no editorial commentary or pieces.

Electronic "advance sheets" for the Sixth Circuit Court of Appeals are posted weekly in a table format with case names, court, date, short description of decisions, and link to full text and are published weekly.  See. www.SixthCircuitCases.com

Both sites have separate RSS and Email subscription fees.

Great news.

We now have exceeded 400 email subscriptions to the www.KyCAses.com updates!

That is NOT counting the visitors who show up via search engines or serindipitously or use an RSS reader.

LawWire Format Changed effective with Jan. 5, 2007 decisions

The "Not Published" portion of the LawWire has been modified, effective Jan. 1, 2007.

We no longer will be listing all the nonpublished decisions within the LawWire.

We have taken the liberty of "annotating" the official minutes with a text block following each decision containing a key word description of the case's legal points.  The "annotation" is in a block in the third column of the Court of Appeals Minutes and in separately blocked and outlined text in the Supreme Court minutes.

Clicking on the hot link of the decision will access the full text of the decision in Adobe PDF format.

From now on, we will continue posting the minutes with a short description of the published cases found in those minutes at www.KyCases.com.  These should be posted by the weekend following the publishing of the minutes (Third Thursday for Supreme Court; each Friday for Court of Appeals).   For an example, click on "Jan. 26, 2006 - Minutes for Kentucky Court of Appeals".

By the time we publish the LawWire a few weeks later, we will then have annotated the minutes with each published and non-published decision containing a small key word description of the case and with each published case highlighted in yellow as you peruse them.

Due to limitations on my time, I had to make this modification.  It's still a bargain (free), and you get each published decision within a week or two (but no later than 4 weeks) of the decision. 

We will continue to post separately the digest of each published decision at www.KyCases.com and put them in one of the categories you will find in the side-column.  For an example, then click here "SOVEREIGN IMMUNITY (SPECIAL RELATIONSHIP): PILE V. CITY OF BRANDENBURG (SC 12/21/2006)"

The LawWire will contain all the published decisions in one separate file (with a PDF copy) and a link to the annotated minutes.

End of Year Subscription Drive

During the month of December I would like your help in promoting this advance sheet service among your lawyer friends by emailing them a link to the page and letting them know they can subscribe to the free-email postings.  Here is a sample email; just copy and send.

I am receiving these free email updates of published decisions from the Kentucky Court of Appeals and Supreme Court with notices of argument calendars, minutes, and AOC news.

The published decisions are separately posted with a the name, date, subject, short digest, and a link to the full text of the decision posted at the AOC's web site.

Go to http://www.KyCases.com and see.  The place for subsribing for the emails is in the top left-hand column.  Enter your email, enter the verification code, and then you will need to respond to the confirmation email (to avoid spam).

If you are interested in the weekly list of published decisions from the Sixth Circuit Court of Appeals (case name, topic covered, and link to full text), then do the same at http://www.SixthCircuitCases.com .

We now have over 350 receiving the emails.  There are many more who just visit the site or have the RSS readers.

Blog Update: Sixth Circuit Decision Changes

Effective immediately, all Sixth Circuit decisions will be posted exclusively at www.SixthCircuitCases.com.

You can obtain a direct RSS feed, direct emails, or visit the site at the URL domain of www.SixthCircuitCases.com.

The reason for the change is to avoid duplicate postings.  Each week at Sixth Circuit Cases, the PUBLISHED decisions will be listed by names, links to full text, date of publication, and district court.   The Kentucky decisions will have the opening paragraphs from the published decisions highlighting the subject covered. 

Blog: Nonpublished Decisions

A reader asked about accessing the nonpublished decisions via the Feedburner emails.

Unlike the published decisions, we do NOT separately post the nonpublished decisions with the links to the AOC full text decisions.

We do include the nonpublished decisions in the bottom of the LawWire organized by topic, name, and short description (no digest) with a LINK to the full text.

You can also access the full text of all the decisions contained in the MINUTES since there is a 'hot link' in the right column which will pull up the full text associated with that decision.

HOW do you access the minutes? 

Well, when I post the posting to the minutes the 'headline' is HOT and clicking on it will pop up the PDF copy of the minutes with the cases and links.

Blog Update: Advance Sheets of Published Decisions Using RSS

Announcement - Kentucky Cases (www.KyCases.com) is now online.

Although my plate is already full, I think the time has come to implement a service that I believe is long overdue - Using RSS technology to bring to your computer each of the published decisions of the Kentucky Supreme Court and Court of Appeals.  This is just a start to see how it works.  Your help and any volunteers would be appreciated. 

This is a service I have suggested, wished, prodded, and plugged for over a year now, and as of yet none of the 'powers that be' has taken the project and ran with it.  'Kentucky Law Blog' is a full-blown legal newspaper, law journal, and periodical wrapped up in one.  www.KyCases.com is Kentucky published decisions and developments in a 'nutshell'.

Some of you just want the bare essentials without frills, fanfare, or commentary.

Well, here it is.  The goal is quick, timely, published decisions only.  Additionally, postings with links to oral argument calendars, press releases, minutes, and rules and orders published. 

To get the site up and running, we have posted all that would have been posted for 2006.  We will actually shoot for posting the dates the decisions are announced rather than the dates we post them (for ease of research and reference). [UPDATED CLARIFICATION:  We may get the cases a few days after it is published but it will be posted with a date of the decision in a nunc pro tunc manner.  This way you can locate a decision a little more easily.  We may digest a Feb. 3 decision on Feb. 10, but will post it with the Feb. 3 date.]
